By accessing or using Artare ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We reserve the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of any changes.
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.
You agree not to: (a) upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) impersonate any person or entity; (c) upload sexually explicit content that is not related to legitimate artistic expression; (d) use the Platform for any unauthorized commercial purpose; (e) interfere with or disrupt the Platform or servers; (f) attempt to gain unauthorized access to other users' accounts.
You retain ownership of all content you upload to Artare. By uploading content, you grant Artare a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform. You represent that you own or have the necessary rights to all content you upload. Artare does not claim ownership of your work.
Artare employs automated and manual content moderation to maintain community standards. Content that is flagged as inappropriate may be removed or restricted. Artists may mark their work as "mature content," which will be displayed with appropriate warnings. Content depicting illegal activity will be removed and may result in account termination and reporting to authorities.
Artare charges a 10% platform fee on all transactions processed through the Platform. Payments are processed securely through Stripe. Artare is not responsible for disputes between artists and clients regarding the quality or delivery of work. Refund policies are handled on a case-by-case basis.
Premium features are available through paid subscription plans. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds for partial billing periods are not provided.
Artare reserves the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Content you have uploaded may be retained for a reasonable period for backup and archival purposes.
Artare is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Artare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you have paid to Artare in the 12 months preceding the claim.
Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration in accordance with applicable laws. You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.
